Frequently Asked Questions
Your questions, answered with clarity.
What are your fees?
We charge an hourly tariff for legal advice, litigation and commercial matters. You can contact us to find out our current hourly tariff.
Property transfers depend on the value of the property. Other services related to the transfer process or that requires registration in the Deeds office, is charge in accordance with the conveyancing fee guidelines set out by the Fidelity Fund. Should you require a free quotation, you are more than welcome to use our contact us.
Do you consult after hours?
Our office hours are Monday to Friday, 08:00 to 16:00.
As a juggling parent and business owner, I understand that life can sometimes make it difficult to take time off work for a consultation. After-hours virtual consultations can be arranged where necessary, providing a convenient alternative for clients who are unable to meet during office hours.
For clients who require assistance with signing documents, mobile signing is also available by prior arrangement, where I can travel to you to facilitate the signing of your documents.
What does commercial law / company law entail?
This would include the drafting of service agreements between service providers or setting out your terms and conditions for the business. Assistance with company administration agreements which include shareholder agreements, sale of a business, company related advice.
How long does it take to transfer a property to my name?
Our timeline at Hanri Swanepoel Inc is usually 6 weeks after the agreement of sale is signed and the instruction is received. However certain transactions can take longer depending on whether a later registration date is required or if there are certain delays that one cannot foresee. We are always transparent with the client and should delays be foreseen, we will inform the client as soon as possible.
What risks are involved that can delay a transaction?
Most delays occur where there are tenants in the property and the Purchaser do not wish to proceed with the tenants in the property.
Estate transfers usually take longer because the Master of the High Court has certain roles to fulfil, which includes consent to sell a property out of the estate or to wait for the Letter of Executorship.
The Deeds office can reject a matter for various reasons, which could not have been foreseen by the Conveyancer, which requires a minimal delay of 7 days.
Delays can also be caused when there are problems with unpaid Municipal and Levy Charges or if SARS queries a transaction.
Can you assist with International Contracts?
Yes, we assist with advice and drafting international agreements; however, should a dispute occur and the agreement is governed by law that is not South African law, I will not be able to advise on the procedures and/or requirements of the courts.
Are there legal services that you do not provide?

If there is a field of law not specifically mentioned that I have not expertise in, I will be able to direct you to attorneys that specialises in those fields.
